1. Contract Fee
An administration fee of £120.00 inc VAT will be payable upon Oscar and Hunt creating a legally binding tenancy agreement.
2. Anti-Money Laundering Regulations
Oscar and Hunt is subject to the Money Laundering Regulations 2007. As a result we will need to ask you for suitable identification,
and will be unable to proceed with any tenancy on your behalf if we are unable to obtain this from you.
3. Referencing Fees and documentation
As part of you signing a new tenancy with Oscar and Hunt you will be required to complete a referencing application from a third party company.
A fee of £120 inc VAT will be charged per tenant. These references may be passed to our client for them to review and make a decision on granting
a tenancy to you.
If you incur any additional administration charges levied by your bank, current landlord/agent or employer in relation to obtaining a reference then this is not included in your referencing fee paid to Oscar and Hunt.
We require the following documents from you before the tenancy can proceed:
3.1 Photo ID [passport or EU Driving Licence]
3.2 Current proof of address
3.3 Last 6 months bank statements
4. Inventory check-in and check-out
The landlord may instruct Oscar and Hunt to make arrangements for the inventory and check-in by a third party. Unless otherwise agreed, the
landlord will be responsible for the cost of the inventory and check-in. The tenant will be liable for the cost of the check-out. If a check-out has been
booked and agreed by you and you are not present or the appointment is missed or not carried out you will be liable for the cost incurred.
We strongly advise you to ensure you make yourself available for the check-in and check-out.
The cost of the check-out [if arranged] will be depend on the size of the property you are renting, and the cost will be made clear to you in writing prior to the commencement of your tenancy. Where a landlord organises this inspection independently of Oscar and Hunt, the charge may vary and again we will inform you if this is being done independently of Oscar and Hunt in writing.
5. Tenancy renewal
Please contact Oscar and Hunt at least 1 month prior to your current tenancy expiring if you wish to extend your tenancy.
If the tenancy is renewed, we will make a charge of £60 inc VAT to cover our administration.
6. Your Deposit
You will need to pay a deposit when taking a new tenancy. In majority of cases we will request a deposit of six weeks' rent. This must be paid in
cleared funds when you sign the tenancy agreement, and is held by the Deposit Protection Service [DPS] for the duration of the tenancy in accordance
with the terms of the tenancy agreement.
If the landlord is protecting the deposit directly themselves, Oscar and Hunt will inform you in writing that this is the case. If and where applicable Oscar and Hunt will register the deposit monies with the DPS on the landlord's behalf.
Oscar and Hunt excludes liability in relation to loss caused by the insolvency of a financial institution which holds deposits in its contracts with landlords and tenants.
7. Deposit deductions
If a deduction is being made from your deposit this must be agreed in writing by both landlord and tenant at the end of your tenancy agreement.
The tenancy agreement entered into is between the landlord and the tenant and, therefore, the tenant cannot hold Oscar and Hunt liable for
any deductions made from the deposit which may fall into dispute between the landlord and tenant.
Any interest earned on the deposit is kept by the DPS and is not payable to the tenant, Landlord or Oscar and Hunt.
Oscar and Hunt is a member of the Deposit Protection Service [DPS].
8. Ending your contract early
If you decide you would like to terminate your tenancy before the end of the contractual term and this is agreed by your landlord,
you will be responsible for the repayment of the pro-rata commission paid in advance by the landlord for the unexpired portion of the
tenancy to Oscar and Hunt. If you are exercising a break clause, which is contained, in your tenancy agreement then there is no charge to you.
If any charges remain outstanding at the end of the tenancy, Oscar and Hunt will apply to the scheme protecting you deposit for this deduction to be made from your deposit.
9. Paying rent
We will require you to pay the first months rent installment in advance in cleared funds when you sign the tenancy agreement. Thereafter, rent is
payable by standing order (unless agreed otherwise) to arrive on the due date as stated in the tenancy agreement. Please note the full rent must be
paid by a single standing order, we are unable to accept multiple standing orders
10. Paying utilities
As apart of your contract you will be responsible for the payment of council tax, telephone, gas, water and electricity accounts at the property during
your tenancy [unless otherwise agreed in writing prior to your tenancy contract commencing]. It is your responsibility to notify the relevant
companies and the local authority that you are moving into/out of the property. You are also responsible for ensuring that a valid television licence
is in place for the duration of your tenancy. Utility companies will also always require the occupant to provide access for any visit, which you must
grant them.
11. Insurance
The landlord is responsible for insuring the building and their contents. We advise it is your responsibility to insure your own belongings throughout
the tenancy.
12. Management of the property
Prior to the tenancy commencing we will advise you who is responsible for managing the property. If we are not managing the
property, we cannot authorise repairs or maintenance at the property. We cannot guarantee the speed at which repairs will be carried out by the
landlord. Where Oscar and Hunt are managing the property, we may have to obtain the landlord's consent before proceeding with a repair. Where
we manage a property and hold a set of keys, it may be possible for us to provide access to one of our approved contractors [with your permission].
If we do not hold keys or a contractor is not able to collect keys, it is your responsibility to provide access for them to ensure works are carried out. Oscar and Hunt will not be liable for any delays caused by non access by tenants.
13. Taxation Laws
If you pay rent directly to your landlord's bank account and your landlord is resident overseas, you will be responsible for
applying the provisions of the HM Revenue and Customs Non-Resident Landlords scheme for taxing UK rental income. Please ask us for advice on
this if required. This does not apply if you are paying your rent to Oscar and Hunt directly.
14. VAT
All charges levied by Oscar and Hunt are subject to VAT at the prevailing rate of 20%. To avoid any confusion and ambiguity all our fees listed will
be inclusive of Vat unless otherwise stated.
15. Complaints procedure
If you are dissatisfied with Oscar and Hunt's service or handling of a transaction, and you are unable to resolve this with the member
of staff involved, please report the matter to the Director of Oscar and Hunt in writing. This complaint will be acknowledged within three working
days of receipt and an investigation undertaken. A formal written response will be sent to you within 15 working days with our final view and will
include any offer made by us in respect of your complaint.
If still dissatisfied by our resolution you may refer the matter to The Property Ombudsman (TPO) within six months for a review. For the avoidance of doubt, TPO will only review complaints made by consumers.
16. Amendments and changes to our terms
Oscar and Hunt reserves the right to change the schedule of fees and these terms of business upon providing reasonable notice
in writing.
